This week, our partner Simone Lahorgue Nunes participated as a speaker in the panel “Data Breach and Privacy: Are Class Actions Delivering Effective Remedies?” at the IBA Annual Conference in Mexico City.
The debate focused on whether class actions are truly effective in holding big tech companies accountable and providing compensation to data subjects.
In her speech, Simone emphasized the importance of addressing privacy breaches from a multijurisdictional perspective, providing an overview of class actions involving data protection in Brazil. She also highlighted that, although Brazil’s LGPD provides for both individual and collective actions in cases of personal data violations, the courts still need to address two important legal uncertainties: whether liability under the LGPD is strict, and how damages in data protection cases should be defined.
