In an interview with Brazilian newspaper, Zero Hora, partner Simone Lahorgue Nunes discussed the legal challenges posed by artificial intelligence, copyright, and the liability of digital platforms for third-party content.
With the launch of her third book, Media and Entertainment Law Textbook, our partner – who also teaches Media and Entertainment Law at FGV Direito Rio – highlighted the lack of structured legal resources for the media and entertainment industry, a field she has been dedicated to for over two decades.
When asked about the recent decision by the Brazilian Supreme Court (STF) concerning the Civil Rights Framework for the Internet (Marco Civil da Internet), Simone noted that the justices were faced with the need to fill a gap left by the legislature.
She was then asked whether any form of regulation amounts to a violation of freedom of expression. In response, she emphasized that while freedom of expression is fundamental — as it serves to protect society — no constitutional principle is absolute, and at times, other principles may take precedence depending on the specific circumstances of the case.
